This online store is operated by WallyFrame, Nikolai Wilberscheid, Pfaffenberger Weg 142, 42659 Solingen, Germany. Throughout these Terms, “WallyFrame”, “we”, “us”, and “our” refer to this business.

These Terms apply when you visit this website or purchase a product from WallyFrame. By using the website or placing an order, you agree to these Terms. Mandatory consumer rights under the law applicable to you remain unaffected.

THE ONLINE STORE

Shopify provides the ecommerce platform used for this store. Products are produced and fulfilled through Gelato and its production and logistics partners. We may update, suspend, or discontinue parts of the website where reasonably necessary.

PRODUCTS AND PRESENTATION

WallyFrame offers photographic wall art and related products. Product images, room mockups, and screen previews are intended to show the design and general appearance. Colors can vary between screens and printed products. Minor variations in color, material, dimensions, or production can occur and do not constitute a defect where they are customary and reasonable.

The product description, available sizes, material, frame options, price, and estimated delivery information displayed before checkout form part of the offer. Please review these details before placing an order.

ORDERS AND CONTRACT FORMATION

Products displayed in the store are an invitation to place an order. By completing checkout, you submit a binding order. After you place an order, you receive an automated confirmation that we have received it. A purchase contract is formed when we accept the order, begin fulfillment, or send a shipping confirmation.

We can reject or cancel an order for a legitimate reason, including incorrect pricing, unavailable products, suspected fraud, delivery restrictions, or technical errors. If payment has already been collected for a canceled order, it will be refunded.

PRICES, TAXES, AND PAYMENT

Prices are shown in the currency selected for your market. Applicable taxes and shipping charges are displayed at checkout where required. You are responsible for providing complete and accurate billing and payment information.

Payment is processed through the payment methods offered at checkout. We do not receive your complete payment card details. Your payment provider may apply additional terms.

PRODUCTION AND AVAILABILITY

Most WallyFrame products are produced to order. Production normally begins after an order has been accepted and payment has been authorized. Availability and production location can depend on the product, destination, stock, capacity, and the fulfillment network.

If a product becomes unavailable after your order, we will contact you and offer an appropriate alternative or refund the affected item.

SHIPPING AND DELIVERY

Available destinations, shipping methods, prices, and estimated delivery dates are displayed at checkout. Delivery dates are estimates and can be affected by production, weekends, public holidays, high order volumes, customs processing, or carrier delays.

Items from one order may be produced at different locations and arrive in separate packages. Risk of accidental loss passes to consumers in accordance with mandatory law, generally when the goods are delivered to you or a person designated by you.

You must provide a complete and accurate delivery address. Contact us immediately if an address is incorrect. Once production or shipping has started, a change cannot be guaranteed.

CANCELLATIONS, RETURNS, AND REFUNDS

You can request cancellation of unfulfilled items within 24 hours of placing an order. Once production or fulfillment has advanced, cancellation might no longer be possible and the return rules apply instead.

Return requests must be made within 14 days after the last item in the order is delivered. For non-defective returns, you are responsible for the direct return shipping costs. We do not charge a restocking fee.

Do not send goods to Gelato or another production partner. Contact us first at niko.w.0804@gmail.com and include your order number. After a return is approved, we provide the valid return address and instructions.

Where permitted by law, goods produced to your individual specifications or clearly personalized can be excluded from cancellation or return. Standard, non-personalized WallyFrame prints are not excluded only because they are made after ordering.

DAMAGED, DEFECTIVE, OR INCORRECT ITEMS

Inspect your order after delivery. If an item is damaged, defective, or incorrect, contact us as soon as possible with your order number, a description, and clear photos of the item and packaging. After review, we will arrange an appropriate remedy, such as replacement or refund. Your statutory rights relating to defective goods remain unaffected.

INTELLECTUAL PROPERTY

Unless stated otherwise, the photographs, designs, text, branding, and other original content on this website belong to WallyFrame or are used with permission. You may browse the website and use purchased products for personal purposes. You may not reproduce, distribute, sell, license, scrape, publish, or commercially exploit our content without prior written permission.

ACCEPTABLE USE

You must not use the website for unlawful, fraudulent, abusive, or harmful purposes. You must not interfere with the security or operation of the store, introduce malicious code, attempt unauthorized access, collect personal data without permission, or infringe the rights of WallyFrame or another person.

THIRD-PARTY SERVICES AND LINKS

The store uses services provided by Shopify, Gelato, payment providers, carriers, and other partners. Their services can be subject to separate terms and privacy notices. Links to third-party websites are provided for convenience. We are not responsible for third-party content or services outside our reasonable control.

LIABILITY

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory product liability.

For other losses, WallyFrame is liable in accordance with applicable law. We are not responsible for losses caused solely by events outside our reasonable control, provided that mandatory consumer rights remain unaffected.

PRIVACY

Personal information is handled as described in our Privacy Policy. Shopify and other service providers process information as necessary to operate the store, fulfill orders, process payments, and provide customer service.

CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the store, services, or legal requirements. The version available at the time of your order generally applies to that purchase unless a mandatory rule requires otherwise.

SEVERABILITY

If any provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply. The invalid provision is replaced, where legally possible, by a valid provision that most closely reflects its purpose.

GOVERNING LAW

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country, this choice does not deprive you of mandatory consumer protections available under the law of your country of residence.
